Marriott International, Inc. with its corporate headquarters at 10400 Fernwood Road, Bethesda, Maryland 20817-1102, United States of America, and its subsidiaries, including The Ritz-Carlton Hotel Company L.L.C. (collectively, “Marriott”, “we”, “our” or “us”) provide various websites available to visitors located throughout the world. Our websites include without limitation, this website, www.marriott.com, www.autograph-hotels.marriott.com, www.vacationsbymarriott.com , www.ritzcarlton.com and www.corporate.ritzcarlton.com (collectively, our “Sites”). These Terms of Use also apply to translations of our Sites, for example, www.espanol.marriott.com. Our Sites are controlled and operated from the United States and are subject to United States law.

  2. The content and information displayed on the Sites are Marriott’s and/or Ritz-Carlton’s property and are collectively referred to as “Marriott Information”. The downloading, reproduction, or retransmission of Marriott Information, other than for non-commercial individual use, is strictly prohibited, except to the extent permitted by travel agents for business-only purposes in accordance with section 11 below.

  3. By using our Sites you are accepting all the terms and conditions set forth below in these Terms of Use. If you do not agree to each and all of these terms and conditions please do not use our Sites. We reserve the right, at our discretion, to change and or modify portions of these Terms of Use at any time without notice and, unless otherwise indicated, such changes will become effective immediately upon posting; therefore, please check these Terms of Use periodically for changes. We will display the effective date of these Terms of Use at the top of this page.

  4. You agree that you will not use any device, software or other instrumentality to interfere or attempt to interfere with the proper working of our Sites, and that you will not take any action that imposes an unreasonable or disproportionately large load on our infrastructure. In addition, you agree that you will not use any robot, spider, other automatic device, or manual process to monitor, scrape, or copy our Sites or the Marriott Information contained therein, or any aspect of the Sites or the Marriott Information, without the prior express consent from an authorized Marriott or Ritz-Carlton representative (such consent is deemed given for standard search engine technology employed by Internet search websites to direct Internet users to our Sites). Furthermore, you agree that you will not use our Sites for any purpose that is illegal, unlawful, or prohibited by these Terms of Use. You agree that you will not interrupt, disrupt, alter, destroy, impair, restrict tamper, or otherwise affect the proper operation of our Sites in any way, including, without limitation, through the use of any malicious or unauthorized code, virus, worm, Trojan horse, malware, or program. You may not use our Sites in any threatening, libelous, slanderous, defamatory, obscene, inflammatory, pornographic, discriminatory, or otherwise offensive manner. We reserve the right in our sole discretion to revoke or deny your access to our Sites, including, without limitation, if you violate any of the provisions of these Terms of Use.

  5. You agree that you will make only legitimate reservations in good faith for use by you and your invited guests only, and not for other purposes, including without limitation, reselling, impermissibly assigning or posting on third party websites, or making speculative, false or fraudulent reservations, or any reservation in anticipation of demand.

  6. Our Sites may provide you with the ability to use usernames, passwords, or other codes or devices to gain access to certain portions of our Sites (“access codes”). You are entirely responsible for maintaining the confidentiality of your access codes and for all activities that occur under your account. We reserve the right to immediately terminate your account in our sole discretion and without prior notice to you wherever there is a reason including, for example, if you violate any part of these Terms of Use.

  7. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR SITES AND MARRIOTT INFORMATION ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE MAKE NO WARRANTIES OR ANY GUARANTY OR ASSURANCE THAT OUR SITES AND/OR MARRIOTT INFORMATION WILL BE AVAILABLE, ADEQUATE, ACCURATE, UNINTERRUPTED, COMPLETE OR ERROR FREE. WE ARE NEITHER RESPONSIBLE NOR LIABLE FOR ANY MALICIOUS OR UNAUTHORIZED CODE AND YOU ARE SOLELY RESPONSIBLE FOR ENSURING YOU HAVE APPROPRIATE SCANNING AND PROTECTIVE MECHANISMS FOR THE SECURITY OF YOUR DEVICES, PROGRAMS AND INFORMATION. BY USING ANY OF OUR SITES AND/OR MARRIOT INFORMATION, YOU ARE ASSUMING ALL RISK OF LOSS THAT MAY ARISE OR BE ASSOCIATED WITH THAT USE.

  8. To the maximum extent permitted by law, we, other members of our group of companies and third parties connected to us hereby expressly exclude any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our Sites or in connection with the use, inability to use, or results of the use of our Sites, any websites linked to them and any materials posted on them, including, without limitation any liability for loss of income or revenue; loss of business; loss of profits or contracts; loss of anticipated savings; loss of data; loss of goodwill; wasted management or office time; and for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable, provided that this condition shall not prevent claims for loss of or damage to your tangible property or any other claims for direct financial loss that are not excluded by any of the categories set out above.

  9. This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability that cannot be excluded or limited under applicable law.

  10. You shall defend us against any demands, claims or actions brought against us or arising as a result of any breach or violation of these Terms of Use by you (“Claim”) and you shall indemnify and hold us harmless from and against any and all losses, damages, costs and expenses (including attorneys' fees) resulting from any such Claim. We have the right, at our expense, to assume exclusive defense against any Claim and all negotiations for settlement and you agree to cooperate with us in the defense of any such Claim, at our request.

  11. With respect to all communications you make to us regarding Marriott Information including but not limited to feedback, questions, comments, suggestions and the like: (a) you shall have no right of confidentiality in your communications and we shall have no obligation to protect your communications from disclosure; (b) we shall be free to reproduce, use, disclose and distribute your communications to others without limitation; and (c) we shall be free to use any ideas, concepts, know-how, content or techniques contained in your communications for any purpose whatsoever, including but not limited to the development, production and marketing of products and services that incorporate such information. The above is limited only by our commitment and obligations pertaining to your personal information (for more information, please see our Privacy Statement).

  12. Marriott Information may contain technical inaccuracies and typographical errors, including but not limited to inaccuracies relating to pricing or availability applicable to your transaction. Neither Marriott nor Ritz-Carlton assume responsibility or liability for any such inaccuracies, errors or omissions, and shall have no obligation to honor reservations or information affected by such inaccuracies. Marriott and Ritz-Carlton reserve the right to make changes, corrections, cancellations and/or improvements to Marriott Information, and to the products and programs described in such information, at any time without notice, including after confirmation of a transaction.

  13. Some areas of our Sites are restricted to travel agents or other authorized representatives. The Marriott Information contained in such restricted areas is confidential to Marriott, and is provided for business use only, which includes reviewing commission status and statements, and enrolling in our Electronic Funds Transfer program as described below. We reserve the right to prohibit access to, or use of, these restricted areas where we determine that such use or access interferes with our Sites’ operations or that such use or access results in commercial benefits or other entities to our detriment. If you are a travel agent or authorized representative of a travel agent using our Sites the following apply:

  14. Passwords: We have provided you with a unique password so that access to information related to your agency and transactions can be restricted to only those individuals to whom you provided the password. It is your responsibility to protect the confidentiality of the password. Neither Marriott nor Ritz Carlton assumes any liability for any access to information or transactions that are executed with the password provided to you. We strongly recommend that you change the password on a periodic basis and whenever a travel agent leaves your travel agency or you suspect that knowledge of the password is no longer limited to those whom you have authorized.

  15. Electronic Funds Transfer (EFT): Marriott may be able to make commission payments by electronic funds transfer (EFT) through the Automated Clearing House (ACH) System. If you complete the EFT registration process provided on our Sites, completion of the process signifies that you: (1) authorize Marriott and/or Ritz-Carlton to make payments by EFT; (2) certify that you have selected the designated depository institution and provided the correct account information; and (3) accept that all such EFTs will occur in accordance with the following: (i) you will give thirty (30) days’ advance notice to Marriott of any changes regarding your depository institution or other payment instructions; and (ii) you accept that all U.S. direct deposits are made with a payment type of “CTX”.

  16. No Arrangements for Prohibited Persons: Each of Marriott International Inc. and The Ritz-Carlton Hotel Company LLC is a United States company and is prohibited from providing services to certain “prohibited persons” who are government officials or residents of certain embargoed countries, or terrorists or drug traffickers whose names are published on lists maintained by the United States Department of Treasury. You agree to use all reasonable efforts not to arrange for any of these prohibited persons to stay at, use or tour any Marriott or Ritz-Carlton facilities.

  17. Our Sites contain information on Marriott and Ritz-Carlton worldwide products and services, not all of which are available in every location. A reference to a Marriott and Ritz-Carlton product or service on one of our Sites does not imply that such product or service is or will be available in your location.

  18. Any use of the maps functionality on this site shall be governed by the End User Terms of Use for Microsoft’s Bing Maps application. Marriott shall have no liability for your use of Bing Maps or for any results, including driving directions, generated by Bing Maps.

  19. If you choose to leave our Sites via links to other third party websites, including those of advertisers, our Terms of Use and our Privacy Statement will no longer apply. We are not responsible for the terms of use or privacy policies of those third-party websites or the cookies they use. In addition, because we have no control over such third-party sites and resources, you acknowledge and agree that Marriott and Ritz-Carlton are not responsible for the availability of such third-party sites or resources, and that neither Marriott nor Ritz-Carlton endorse or are responsible or liable for any content, advertising, products, or other materials on or available from such third party sites or resources.

  20. These Terms of Use shall be construed and enforced under the laws of the State of Maryland, USA, applicable to contracts executed and performed within Maryland, USA. You specifically agree and submit to the jurisdiction of the State and Federal Courts situated in the State of Maryland and stipulate to the fairness and convenience of proceedings in such courts for all disputes arising out of or relating to the use of our Sites. You will not object to jurisdiction or venue on the grounds of lack of personal jurisdiction, inconvenient forum or otherwise. You agree that you will not file or participate in a class action against us. YOU HEREBY WAIVE ANY RIGHT YOU MAY NOW HAVE OR HEREAFTER POSSESS TO A TRIAL BY JURY. The foregoing shall not apply to the extent that applicable law in your country of residence requires application of another law and/or jurisdiction and this cannot be excluded by contract.

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING. Void in Quebec and where prohibited by law. Subject to all federal, state, local, provincial and municipal laws. Contest begins on February 15, 2015 at 12:00 a.m. Eastern Time ("ET") and ends on June 15, 2015 at 11:59 p.m. ET (the "Contest Period"). Administrator's computer is the official time keeping device for this Contest.

1. Eligibility: The Marriott Hotels Travel Brilliantly GoPro Contest ("Contest") is open to legal residents of the fifty (50) United States (including the District of Columbia), Puerto Rico, U.S. Virgin Islands, Canada (excluding Quebec), the United Kingdom, Venezuela, Colombia, Argentina, Curacao, Mexico, Costa Rica, Aruba, Grand Cayman, Peru, Ecuador, St. Kitts, and Panama who, as of date of entry, are at least eighteen (18) years of age or the age of majority in their respective states/jurisdictions of permanent residence, whichever is greater. Employees, officers, and directors of Marriott International, Inc. ("Sponsor"), Nobox Marketing Inc. ("Administrator"), Don Jagoda Associates, Inc., GoPro, Inc., and any of their respective parents, affiliates, subsidiaries, franchisees, mandataries, representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment, and marketing agencies, web site providers, web masters, and members of their immediate families (spouses, parents, siblings and children, regardless of where they live) and those living in the same household (whether or not related) are not eligible to enter or win. Then, bring your footage to a designated Marriott Program Manager and complete the release form provided to receive one (1) entry into that month's (as defined below) First Prize judging. If you do not wish to bring your footage to a designated Marriott Program Manager, you may also submit your footage on Twitter or Instagram, as outlined below.

2. To enter via Twitter, you must tweet on Twitter a photograph/video of your best moments during your stay at a participating property, or if you are not staying at a participating property, your best moments during your travels ("Tweet" or "entry") to receive one (1) entry into that month's (as defined below) First Prize judging. The Tweet must include #travelbrilliantly or #viajegenial, and #gopro within the entry. You must have a public Twitter account to enter. If you do not have a Twitter account, and you would like to create one for free, visit www.Twitter.com. Including #travelbrilliantly or #viajegenial, and #gopro in a Tweet during the Contest Period constitutes your agreement to these Official Rules.

3. To enter via Instagram, you must upload a photograph/video of your best moments during your stay at a participating property, or if you are not staying at a participating property, your best moments during your travels and include #travelbrilliantly or #viajegenial, and #gopro within the photo/video caption to receive one (1) entry into that month's (as defined below) First Prize judging. You must have a public Instagram account to enter. If you do not have an Instagram account, and you would like to create one for free, download the free Instagram app at the Apple® App Store, Windows Marketplace, or the Google® Play store. Including #travelbrilliantly or #viajegenial, and #gopro in the photo/video caption during the Contest Period constitutes your agreement to these Official Rules.

No information regarding entries, other than as otherwise set forth in these Official Rules, will be disclosed. Entries must be received during the Contest Period. Entries will be carried forward to subsequent month's First Prize winner determination, if any. Limit one (1) entry per person, per day, regardless of method of entry. For the purposes of this Contest, a "day" is defined as beginning at 12:00 a.m. ET each calendar day and ending at 11:59 p.m. ET the same calendar day. For the purposes of this Contest, a "month" is defined as beginning at 12:00 a.m. ET the 16th of each calendar month and ending at 11:59 p.m. ET the 15th of the next calendar month, with the exception of the first month, which will begin at 12:00 a.m. ET on February 15, 2015 and end at 11:59 p.m. ET on March 15, 2015. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void such entries and that entrant may be disqualified. Use of any automated or computer system to participate is prohibited and will result in disqualification. Normal Internet access and usage charges imposed by your online service may apply. If entering via mobile device, normal phone/data and usage charges imposed by your phone service may apply.

Incomplete, corrupted, or untimely entries are void and will be disqualified. Sponsor and its agencies are not responsible for lost, late, incomplete, damaged, stolen or misdirected entries; lost, interrupted, or unavailable network, server, or other connections; or miscommunications, computer or software malfunctions, telephone transmission problems, technical failures, garbled transmissions, damage to a user's computer equipment (software or hardware), or other errors or malfunctions of any kind, whether human, mechanical, electronic or otherwise. Proof of submission will not be deemed to be proof of receipt by Sponsor. In the event of a dispute as to the identity of an entrant, the authorized account holder of the email address or the email address associated with the Twitter account/Instagram account used to enter will be deemed to be the entrant or participant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider, Internet service provider, or other organization (which may include an employer) responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder. Entries specifying an invalid, non-working, or inactive email address will be disqualified and ineligible to win.

Entries must be unique. Footage/photo/video entries must be tweeted/posted in accordance with the Twitter Terms of Service and/or Instagram Terms of Use. All entries must comply with the "Entry Requirements" set forth below.

Entry Requirements:

• Entry captions must comply with the character limitations for Twitter and Instagram and must be in English or Spanish.

• Entry may feature additional people in footage/photo/video. If so, please make them aware that you are submitting their image in this Contest and that they agree to the submission of their image. If an additional person is a minor is his/her state of primary residence, entrant must be parent or legal guardian of minor depicted. If photo/video features additional people, they (or entrant as parent or legal guardian) may be required to sign a Release Form, in Sponsor's sole discretion.

• Entry must be your original idea (modification of an original work is not an original idea). Entries must not copy or otherwise plagiarize from any source.

• The entry must not have been submitted previously in a giveaway or promotion of any kind or previously exhibited or displayed publicly (i.e., disclosed beyond your immediate circle of friends and family) through any means.

• The entry must not contain content that is known by you to be false, inaccurate or misleading.

• Any entry deemed inappropriate or unsuitable, in Sponsor's sole discretion, will be disqualified. Entries must not contain material that is inappropriate, indecent (including, but not limited to, nudity, or pornography), profane, obscene, hateful, tortious, defamatory, slanderous, libelous (including words or symbols that are widely considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation, or socioeconomic group), violent, self-mutilating (e.g., relating to murder, the sales of weapons, cruelty, abuse, etc.), or illegal (e.g., underage drinking, substance abuse, computer hacking, etc.).

• The entry must not contain or depict material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination, including without limitation, discrimination based on race, sex, religion, nationality, disability, sexual orientation or age. The entry must not contain or depict material that is threatening to any person, place, business, group, or world peace or contain words or symbols that are widely considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation, or socioeconomic group.

• The entry must not contain any content that infringes or may infringe third party rights, including, without limitation, any copyright, name, trademark, logo, trade dress, or other personal or proprietary right of any person living or deceased (including but not limited to rights of privacy or publicity or portrayal in a false light) or entity or make reference to any commercial/corporate advertising (including but not limited to corporate logos, brand names, charities, slogans, political, or religious statements), or be otherwise objectionable. Without limiting the generality of the foregoing, publicly displayed and publicly accessible Sponsor content, materials, or products are permitted to be displayed in entries submitted for this Contest.

• Any clothing shown in the footage/photo/video should not contain any visible logos, drawings, cartoons, phrases, trademarks or other third-party content or materials (but showing publicly displayed or publicly accessible Sponsor content, material, and products as described above is permitted).

• The entry must not include any representation of celebrities, athletes, musicians, or any other third-party (public or private), include any anti-social, political or religious groups, any commercial solicitation or promotional materials or name, address, phone number, or URL address. Entries must not contain advertisements, personal solicitations or commercial solicitations.

• Footage/videos must not include music protected by a copyright (but including music that you own or have the rights to use is permitted).

• Footage/photos may not be owned, taken or edited by a professional photographer. Footage/videos may not be owned, taken or edited by a professional videographer.

• The entry must not contain viruses, Trojan horses, worms, bots, spyware or any other computer code that is intended to damage, interfere with, or surreptitiously intercept or expropriate any system, data or information.

• Entrants and all submitted entries must be in keeping with Sponsor's image as determined by Sponsor, in its sole discretion, or entry will be disqualified from the Contest. The entry must not disparage persons or organizations associated with Sponsor.

• Entries must not reference any of Sponsor's competitors.

Each Entrant grants to Sponsor a worldwide, royalty-free, perpetual, non-exclusive right and license to copy, distribute, and display each submitted entry, in any media, and with right to use, copy, modify, edit, and create derivative works therefrom, and agrees to execute documents confirming such right and license at Sponsor's reasonable request. By entering, you understand that your entry will be screened by the Sponsor and may be posted online to the Sponsor's social media sites, in Sponsor's sole discretion, to be viewed by members of the general public. By entering, each entrant warrants and represents that his/her entry is original, has not been previously published or won any award, does not contain any material that would defame or otherwise violate or infringe upon the rights of any third party, including patents, copyrights, trademarks or rights of privacy or publicity, and will not violate any federal, state or local laws or ordinances. Sponsor reserves the right in its sole and unfettered discretion to disqualify any entry that it believes contains obscene, offensive or inappropriate content, that does not comply with these Official Rules or that is not consistent with the spirit or theme of the Contest. No information regarding entries, other than as otherwise set forth in these Official Rules will be disclosed.

4. Determination of Winners: On or about the Wednesday following the close of each month, all eligible entries received by the end of the previous month (as described above) will be judged by a panel of Sponsor representatives based on the following criteria:

  1. 40% - Originality/creativity of entry
  2. 20% - Quality of entry
  3. 40% - Relevance to "Travel Brilliantly" Theme

The two (2) entries determined each month to receive the highest scores from the judges will be deemed the potential First Prize winners for that month, subject to verification, for a total of eight (8) First Prize winners.

On or about June 17, 2015, all entries will be re-judged by a panel of Sponsor representatives based on the following Grand Prize Judging Criteria:

  1. 30% - Originality/creativity of entry
  2. 20% - Quality of entry
  3. 30% - Relevance to "Travel Brilliantly" Theme
  4. 20% - Marketability of entry

The two (2) entries that receive the highest scores from the judges based on the Grand Prize Judging Criteria will be deemed the potential Grand Prize winners, subject to verification. In the event of a tie in either round of judging, tied entries will be re-judged based 100-percent (100%) on Originality/creativity of entry.

Decisions of the Sponsor and judges are final with respect to all matters relating to the Contest. By participating, entrants agree to the decisions of the Judges, which shall be final and binding in all respects. Under no circumstance will information regarding judging be shared with entrants.

5. Winner Notification: Potential winners on property will be notified via email. Potential winners from Twitter/Instagram will be notified by direct message/comment on Twitter/Instagram and confirmed by email. Potential winners from Twitter/Instagram must respond to direct message/comment within seventy-two (72) hours of notification attempt or prize will be forfeited and an alternate winner will be determined and notified as indicated above, time permitting. Each potential winner will be sent via email, an Affidavit/Declaration of Eligibility, Liability & Publicity Release (where legal) and Assignment of Rights ("Affidavit/Declaration") and will be required to complete, sign and return Affidavit/Declaration via email/fax within five (5) days of being notified in order to claim his/her prize.

If a potential winner fails to return the required document within the required time period, or the prize notification is returned undeliverable, or in the event that a potential winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner determined as outlined in section 4 from among all remaining eligible entries received by the end of the applicable month (for a First Prize) or from among all eligible entries (for Grand Prizes), time permitting. All prizes will be awarded provided a sufficient number of eligible entries are received for each month and overall.

Potential winners are subject to verification by Sponsor and/or Administrator, whose decisions are final and BINDING IN ALL MATTERS RELATED TO THE CONTEST. An entrant is not a winner of any prize unless and until entrant's eligibility has been verified and entrant has been notified that verification is complete.

6. Prizes and Approximate Retail Values ("ARV"): Grand Prize (2): 175,000 Marriott Rewards points redeemable for a maximum of a five (5) night stay in a Marriott portfolio property and one (1) GoPro Hero4 Silver Camera Kit. The ARV of each Grand Prize is USD$2,607.48. First Prize [eight (8) - two (2) per month]: 105,000 Marriott Rewards points redeemable for a maximum of a three (3) night stay in a Marriott portfolio property and one (1) GoPro Hero4 Silver. The ARV of each First Prize is USD$1,712.49. Marriott Rewards Points will be calculated to be consistent with a category 7 redemption level.

The total ARV of all prizes is USD$18,914.88. Limit one (1) First Prize and one (1) Grand Prize per person.

Prize Restrictions: Prizes cannot be substituted, assigned, transferred, or redeemed for cash; however, Sponsor reserves the right to make equivalent prize substitutions at its sole discretion if any advertised prize (or portion of a prize) becomes unavailable. Winners are responsible for any loss of prize or portion of prize after it has been delivered. Sponsor will not replace any lost or stolen prizes. Any and all applicable federal, state, and local taxes and all fees and expenses related to acceptance and use of prizes not specifically stated herein are the sole responsibility of the prize winners. Winners from the United States will be issued a 1099 tax form for the actual retail value of prize. The ARV of any prize listed is subject to price fluctuations in the consumer marketplace based on, among other things, any gap in time between the date the ARV is estimated for purposes of these Official Rules, and the date the prize is awarded or redeemed. If the actual purchase price of a prize is less than the ARV stated herein, the prize winner will NOT be entitled to a check, cash or other form of payment for the price difference. Marriott Rewards® Points are subject to terms and conditions, which can be found at www.marriottrewards.com. Winners will be required to become a Marriott Rewards Program member in order to receive (and redeem) Marriott Rewards points.

7. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity or proper functioning of the Contest, as determined by Sponsor in its sole discretion and in the event of cancellation, applicable winners will be determined as outlined in section 4 above from among all eligible entries received by the end of each month (or overall for Grand Prize winners) prior to cancellation. Sponsor, Administrator, Don Jagoda Associates, Inc., GoPro, Inc., Twitter, Instagram, and their agencies are not responsible for lost, late, incomplete, damaged, stolen or misdirected entries; lost, interrupted, or unavailable network, server, or other connections, garbled transmissions or miscommunications, telephone transmission problems; computer or software malfunctions or damage to a user's computer equipment (software or hardware); technical failures; or other errors or malfunctions of any kind whether human, mechanical, electronic, or otherwise. Proof of sending or submission of entry will not be deemed proof of receipt by Sponsor or Administrator. Sponsor's or Administrator's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

WARNING: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE ASSOCIATED WITH THIS CONTEST OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAW, AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be attempting to tamper with or undermine the entry process, and/or the legitimate operation of the Contest; to violate the Official Rules; or to act in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten, or harass any other person. If, for any reason, the Contest is not capable of running as planned, Sponsor may, in its sole discretion, void any suspect entries and (a) modify the Contest or suspend the Contest to address the impairment and then resume the Contest in a manner that best conforms to the spirit of these Official Rules; or (b) applicable winners will be determined as outlined in section 4 above from among all eligible entries received by the end of each month (or overall for Grand Prize winners) up to time of impairment.

Release and Limitations of Liability: By participating in this Contest, entrants agree that Sponsor, Administrator, Don Jagoda Associates, Inc., GoPro, Inc., and each of their respective parents, affiliates, subsidiaries, franchisees, representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment and marketing agencies, website providers, web masters, and their respective officers, directors, employees, representatives and agents (the "Released Parties") are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Contest or receipt or use or misuse of any prize. IF ANY USE BY SPONSOR OF THE SUBMISSIONS CAUSES IT TO BE LIABLE TO ANY THIRD PARTY, ENTRANT AGREES TO INDEMNIFY SPONSOR AND ITS AGENTS, EMPLOYEES, AFFILIATES, SUBSIDIARIES, REPRESENTATIVE AND ALL RELATED PARTIES FROM AND AGAINST ANY AND ALL DAMAGES, COSTS, JUDGMENTS AND EXPENSES (INCLUDING REASONABLE ATTORNEY FEES) WHICH IT INCURS AS A RESULT OF ITS USE OF THE SUBMISSIONS.

10. Nature of Relationship/Waiver of Equitable Relief: Each entrant understands and acknowledges that Sponsor has wide access to ideas, designs, and other materials, and that new ideas are constantly being submitted to it or being developed by their own employees. Each entrant also acknowledges that many ideas may be competitive with, similar or identical to the entry and/or each other in theme, idea, format or other respects. Each entrant acknowledges and agrees that such entrant will not be entitled to any compensation as a result of Sponsor's use of any such similar or identical material. Each entrant acknowledges and agrees that the Sponsor does not now and shall not have in the future any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or protection of the copyright in and to the entry. Finally, each entrant acknowledges that, with respect to any claim by entrant relating to or arising out of Sponsor actual or alleged exploitation or use of any entry or other material submitted in connection with the Contest, the damage, if any, thereby caused to the applicable entrant will not be irreparable or otherwise sufficient to entitle such entrant to seek injunctive or other equitable relief or in any way enjoin the production, distribution, exhibition or other exploitation of the entry or any material based on or allegedly based on the entry, and the entrant's rights and remedies in any such event shall be strictly limited to the right to recover damages, if any, in an action at law.

11. Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the District of Maryland or the appropriate State Court located in Maryland; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Maryland, without giving effect to any choice of law or conflict of law rules (whether of the State of Maryland or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Maryland.

12. Privacy: Information collected from entrants is subject to the Sponsor's Privacy Policy, which can be found at www.marriott.com/privacy. Entrants should be aware that Sponsor may be collecting non-public, personally-identifiable information about them in connection with the operation of the Contest. Entrant's information will be transferred to the United States.
